Privacy Officer: Cory Killeen. Questions about this notice can go to the phone number or address above, or through your patient portal.
Our duties
We are required by law to keep your protected health information (PHI) private and secure. We must:
- Give you this notice of our legal duties and privacy practices, and follow the notice currently in effect.
- Tell you promptly if a breach occurs that may have compromised the privacy or security of your information.
- Not use or share your information other than as described here unless you tell us we can in writing.
Washington and Oregon law may give some information (such as mental health, sexually transmitted infection, or HIV information) more protection than federal law. Where state law is stricter, we follow it.
How we use and share your information
Treatment. We use your information to care for you and share it with others involved in your care. Examples: ordering labs through Quest Diagnostics, sending prescriptions to your pharmacy, and coordinating with your primary care provider, OB/GYN, or a specialist we refer you to.
Payment. We use your information to collect payment for services. Examples: processing your card payment and preparing a superbill you request to submit to your insurance.
Health care operations. We use your information to run the practice and improve care. Examples: reviewing the quality of care, managing scheduling, and sending appointment reminders through your patient portal.
People involved in your care. We may share relevant information with a family member, friend, or caregiver you identify, unless you object. If you cannot tell us your preference (for example, in an emergency), we may share information if we believe it is in your best interest.
Other uses the law allows or requires. We may share information without your authorization when:
- Required by federal, state, or local law
- For public health activities, such as reporting disease, adverse drug reactions, or product recalls
- To report suspected abuse, neglect, or domestic violence, as the law requires
- For health oversight activities, such as licensing reviews and audits
- In response to a court order, subpoena, or other lawful process
- For certain law enforcement purposes, within the limits the law sets
- To prevent a serious and imminent threat to the health or safety of you or others
- To coroners, medical examiners, funeral directors, or organ donation organizations
- For workers' compensation claims
- For specialized government functions, such as military or national security purposes
We share only the minimum information needed for the purpose, except for treatment.
Uses that need your written permission
We will ask for your written authorization before we:
- Use your information for marketing, other than face-to-face conversations or treatment recommendations
- Sell your information (we do not sell patient information)
- Use or share psychotherapy notes, if any exist
- Use or share your information for any purpose not described in this notice
You may revoke an authorization in writing at any time. Revoking it stops future sharing but does not undo sharing that already happened.
We do not use patient information for fundraising.
Substance use disorder treatment records
We are not a substance use disorder (SUD) treatment program, but we may receive SUD treatment records about you from programs covered by federal law at 42 CFR Part 2.
- If we receive Part 2 records under your consent for treatment, payment, and health care operations, we may use and share them as permitted by HIPAA and Part 2.
- We will not use or share Part 2 records, or testimony about their contents, in any civil, criminal, administrative, or legislative proceeding against you unless you give specific written consent or a court orders it after giving you notice and an opportunity to be heard.
- Information shared under HIPAA may be shared again by the person or organization that receives it. Once that happens, it may no longer be protected by federal privacy rules.
We do not use Part 2 records for fundraising.
Your rights
To use any of these rights, send a request through your patient portal or in writing to the address above.
- See and get a copy of your records. You can get your records on paper or electronically, usually within 30 days. We may charge a reasonable, cost-based fee.
- Ask us to correct your records. If you think information is wrong or incomplete, ask us to correct it. We will respond within 60 days, and explain in writing if we say no.
- Get a list of disclosures. You can ask for a list of times we shared your information in the past six years, other than for treatment, payment, operations, and some other purposes. One list per year is free.
- Ask us to limit what we share. You can ask us not to use or share certain information. We are not required to agree, except as below.
- Restrict sharing with your health plan. If you pay for a service in full yourself, you can ask us not to share it with your health insurer. We will agree unless the law requires sharing.
- Choose how we contact you. You can ask us to reach you a specific way (for example, only through the portal) or at a different address. We will agree to reasonable requests.
- Get a paper copy of this notice. You can ask for a paper copy at any time, even if you received it electronically.
- Choose someone to act for you. A person with your medical power of attorney, or your legal guardian, can use your rights for you.
- Be told of a breach. We will notify you if a breach affects your unsecured information.
How we communicate with you
Your secure patient portal is the right place for any message about your health. Please do not send health information by regular email or text; those channels are not secure.
If you ask us to use regular email or text anyway, we will first tell you about the risk and get your agreement. You can change your mind at any time.
Complaints
If you believe your privacy rights were violated, you can file a complaint with us or with the federal government. We will not retaliate against you for filing a complaint.
